Status Guide

What Each Trademark Status Means

Every application moves through these stages at the India Trade Marks Registry. Know what yours means — and what to do about it — before a deadline slips past.

Filed / Pending

Submitted and awaiting examination by the Registry. No action needed yet, but keep watching — this can change to Objected or Advertised at any time.

Objected

The Examiner has raised concerns, usually under Section 9 or 11 of the Trade Marks Act. A reply is due within 30 days or the application risks being treated as abandoned.

See Objection Reply Service

Advertised

Passed examination and published in the Trademark Journal for a 4-month public opposition window. No response required unless someone opposes it.

Opposed

A third party has formally challenged the mark. A counter-statement is due within 2 months of the notice, or the application is deemed abandoned.

See Opposition Defence Service

Registered

Fully protected — the owner has exclusive rights. Registration is valid for 10 years and must be renewed to stay in force.

See Renewal Service

Abandoned / Refused

The application did not go through, usually from a missed deadline or an unresolved objection. In most cases a fresh, properly drafted application succeeds where the earlier one failed.

Why It Matters

Why You Should Track Your Application's Status

Catch Objections in Time

Miss the 30-day window to reply to an objection and your application can be treated as abandoned — often before you even receive the physical notice.

Never Miss a Renewal

A registered mark is only protected for 10 years. Track the date so renewal fees never sneak past and hand your brand to a lapse.

Confirm Before You Grow

Signing a franchise deal, listing on a marketplace, or raising funds? Lenders and partners will ask for proof of status — have it ready.

Spot Opposition Early

A competitor opposing your mark has a fixed 2-month reply window. Checking status regularly is the only way to know it's happened.
